If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and complete information and to keep it up to date.

We strive to describe and display our products accurately, but we do not warrant that product descriptions, pricing, images, or other content are error-free, complete, or current. All orders are subject to acceptance and availability, and we reserve the right to refuse or cancel any order for any reason, including suspected fraud or pricing errors.

Prices are subject to change without notice. You are responsible for any applicable taxes and shipping charges disclosed at checkout.

If you enroll in a filter-replacement or subscription plan, you authorize us to charge your payment method on a recurring basis according to the plan you select, until you cancel. You may cancel or modify a subscription at any time in accordance with the plan terms disclosed at purchase. Cancellation takes effect at the end of the current billing cycle unless otherwise stated.

By providing a payment method, you represent that you are authorized to use it and authorize us (and our payment processors) to charge the total amount of your order, including taxes and shipping. If a payment cannot be processed, we may suspend or cancel your order or subscription.

Shipping timelines are estimates and not guarantees. Risk of loss passes to you upon delivery to the carrier. Returns, refunds, and product warranties are governed by our posted policies, which may be updated from time to time and are incorporated into these Terms by reference. Please review those policies before making a purchase.

By expressly opting in to WaterGnome SMS communications, you agree to receive text messages from WaterGnome at the mobile number you provide. Messages may include promotional offers, product information, quote follow-ups, appointment or customer-service communications, and other WaterGnome-related communications.

Message frequency varies. Message and data rates may apply depending on your wireless carrier and plan.

You may opt out at any time by replying STOP to any WaterGnome text message. After opting out, you may receive a final confirmation message. For assistance, reply HELP or contact WaterGnome at hello@watergnome.com or 855-554-6663.

Consent to receive marketing text messages is not a condition of purchasing any WaterGnome product or service.

Wireless carriers are not liable for delayed or undelivered messages.

You must be at least 18 years old to participate in the WaterGnome SMS messaging program.

Your participation in the SMS program is also subject to our Privacy Policy.

You agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose.
• Interfere with or disrupt the integrity or performance of the Services.
• Attempt to gain unauthorized access to any systems or accounts.
• Copy, scrape, or reproduce content without our prior written permission.
• Infringe the intellectual property or other rights of WaterGnome or any third party.

All content on our website, including text, graphics, logos, images, and software, is the property of WaterGnome or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. All rights not expressly granted are reserved.

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free.

TO THE FULLEST EXTENT PERMITTED BY LAW, WATERGNOME AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

You agree to indemnify and hold harmless WaterGnome and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with your use of the Services or your violation of these Terms.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.

We may modify these Terms at any time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
